Appeals court to review BofA $8.5 billion MBS pact (Reuters)

(Reuters) ? A U.S. appeals court agreed to resolve a dispute among institutional investors over whether Bank of America Corp's $8.5 billion mortgage debt settlement should be sent back to a New York state court for approval.

The 2nd U.S. Circuit Court of Appeals in New York on Tuesday said it plans to rule within a 60-day period on whether U.S. District Judge William Pauley in Manhattan correctly took the case from the state court.

It granted the requests of Bank of New York Mellon Corp, which as trustee negotiated the settlement, and investors including BlackRock Inc, MetLife Inc and Allianz SE's Pimco to appeal Pauley's decision.

Other investors, led by a group called Walnut Place, preferred that the case stay in federal court, which could result in higher recoveries.

The June settlement was intended to address much of Bank of America's remaining legal liability from the Charlotte, North Carolina-based bank's 2008 purchase of mortgage lender Countrywide Financial Corp.

It would cover claims by investors in 530 mortgage securitization trusts with $174 billion of unpaid principal that the home loans underlying their investments were toxic or underwritten poorly.

Bank of New York Mellon had negotiated the accord with 22 institutional investors, and sought approval by New York State Supreme Court Justice Barbara Kapnick in Manhattan.

But Walnut Place and other investors that were not part of the talks, but would be bound by the outcome, complained that the $8.5 billion payout was too low.

Moving the case to federal court could make it easier for these investors to back out, or negotiate higher payouts.

In a two-page order, the 2nd Circuit asked the parties to address several issues, including whether the settlement was a "mass action" allowing federal court review.

"We have jurisdiction to determine our jurisdiction," the 2nd Circuit said.

Pauley had on October 19 said the case implicated "paramount federal interests" such as the integrity of nationally chartered banks and the vitality of financial markets.

Bank of America spokesman Lawrence Grayson declined to comment. Bank of New York Mellon spokesman Kevin Heine and David Grais, a lawyer for Walnut Place, did not immediately return calls.

The 2nd Circuit also granted Bank of America's request to file papers supporting requests for an appeal.

The cases are Bank of New York Mellon v. Walnut Place LLC et al, 2nd U.S. Circuit Court of Appeals, Nos. 11-4554 and 11-4571.

GSM phones vulnerable to hijack scams: researcher (Reuters)

BERLIN (Reuters) ? Flaws in a widely used wireless technology could allow hackers to gain remote control of phones and instruct them to send text messages or make calls, according to an expert on mobile phone security.

They could use the vulnerability in the GSM technology -- which is used by most telecom operators globally and by billions of people -- to make calls or send texts to expensive, premium phone and messaging services in scams, said Karsten Nohl, head of Berlin-based Security Research Labs.

Nohl is a well-regarded expert on mobile security who last year identified a bug in GSM technology that makes calls vulnerable to tapping. He says he is calling attention to these flaws to pressure the industry into beefing up the security of their products.

Mobile security is a hot issue because hackers are paying unprecedented attention to the devices as smartphone sales have outpaced sales of PCs.

Only a few flaws have been found in GSM technology - which stands for Global System for Mobile Communications - over its 20-year history. Industry lobby group GSMA said on Tuesday it did not expect the new findings to affect its views on the security of the technology.

"The GSMA and its mobile network operator members are confident in the security of existing 2G GSM networks and real attacks on real networks against real customers are most unlikely," it said in a statement, adding that newer technologies are safer and not impacted by the new research.

GSMA's statement "on anticipated GSM security announcements" did not make clear whether the industry group had actually seen Nohl's latest research.

Security experts have previously identified a small number of viruses designed to infect smartphones, allowing hackers to take control of the devices and force them to make calls or send text messages. But Nohl said he has discovered a way to leverage previously disclosed vulnerabilities in GSM technology that could potentially threaten hundreds of thousands of phones.

"We can do it to hundreds of thousands of phones in a short time frame," Nohl told Reuters ahead of a presentation on the topic at a hacking convention in Berlin on Tuesday.

SECTOR IN FOCUS

Smartphone malware is popping up at an unprecedented rate as people put more and more valuable information on the devices, using them to hold corporate secrets, conduct banking and function as digital wallets.

GSM became the dominant mobile technology globally in the late 1990s and even though new, faster mobile networks have been rolled out across the world, operators have stuck to their GSM networks to support older phones and to offer service when new networks fail.

The Berlin convention takes place just days after U.S. security think tank Strategic Forecasting Inc (Stratfor) said its website had been hacked and that some names of corporate subscribers had been made public. Activist hacker group Anonymous claimed responsibility.

Attacks on corporate landline phone systems are fairly common, often involving bogus premium-service phone lines that hackers set up in countries in Eastern Europe, Africa and Asia.

Fraudsters make calls to the numbers from hacked business phone systems or mobile phones, then collect their cash and move on before the activity is identified.

The phone users typically do not realize the problem until after they receive their bills, and telecommunications carriers often end up footing at least some of the costs.

Even though Nohl will not present all details of possible attacks at the conference, he said hackers will usually replicate the code needed for attacks within a few weeks.

T-MOBILE, SFR LEAD NEW RANKING

Mobile networks of Germany's T-Mobile and France's SFR offer their clients the best protection against online criminals wanting to intercept their calls or track their movements, according to a new ranking Nohl will unveil at his presentation.

The new ranking, at gsmmap.org, is conducted by security researchers, who hope this will heighten the awareness of operators and consumers on the vulnerability of their mobile communications.

Researchers reviewed 32 operators in 11 countries and rated their performance based on how easy it was for them to intercept the calls, impersonate someone's device or track the device.

"None of the networks protects users very well," Nohl said.

The sample is set to grow from 32 carriers dramatically next year as the tool enables anyone to participate in data gathering

by downloading measuring software to their phones.

Nohl said mobile telecom operators could easily improve their clients' security, in many cases by just updating their software.

Researchers reviewed operators in Austria, Belgium, the Czech Republic, France, Germany, Hungary, Italy, Morocco, Slovakia, Switzerland and Thailand.

Introduction
Have you ever wondered how a radio can receive music and news broadcasts over thin air? Radios, as well as radio-controlled cars and cell phones, all receive information via invisible waves. Some of these waves are called radio waves.

Radio waves are a type of electromagnetic radiation, a kind of energy that also includes visible light. Radio waves are not harmful but are in fact extremely useful for communicating across long distances. To send information using radio waves, a transmitting antenna sends out a radio wave at a certain frequency (which can tell us the size of the wave), and this is picked up by a receiving antenna. Some materials can block, or interfere with, radio waves. Have you ever noticed that you lose reception on a car radio or cell phone when you drive into a tunnel or an underground parking garage? What materials block the radio waves, and which ones allow the waves to easily pass through?

Background
A transmitting antenna, or transmitter, generates and sends out radio waves thanks to a specific electrical current. This is possible because inside transmitters are wires that allow negatively charged particles, called electrons, to flow through them, which makes an electrical current. When current flows within a wire, it generates an electromagnetic field around the wire. This electromagnetic field radiates out of the antenna in all directions, creating invisible radio waves.

When the electromagnetic radio waves hit a receiving antenna, or receiver, such as a radio, it generates a current inside of a wire in the receiver. (The reverse process of what happened in the transmitter when the current generated the electromagnetic field in the first place.) The receiver then processes the current back into the transmitted information, which, for a radio, allows you to hear music or other broadcasts. Some materials can block the radio waves that the transmitter generates, which can be tested by seeing whether a receiver can process and respond to information sent by a transmitter.

??? ?A smooth, wide open space to test drive your radio-controlled car

Preparation
??? ?First check the radio-controlled car and its remote control to make sure they both have fresh batteries. Check that the car runs well on the open space that you will be using.
??? ?Make sure you have enough of each material you want to test (the cotton, aluminum foil, plastic wrap, wax paper, and rubber glove) to completely cover the RC car remote control. Every covering should be loose enough so you can still operate the remote control buttons through it.

Procedure
??? ?Wrap the remote control in cotton. Make sure that the remote control is completely and securely covered so that there are not any openings or holes in the covering, and that it is covered loose enough so that you can still operate the controls.
??? ?Try to operate the radio-controlled car using the cotton-covered remote control. Does it work? Does the car move at all?
??? ?Remove the tested material from the remote control. Test to make sure that the car still works when it is not covered with any material.
??? ?Repeat this process using each different material separately. For which materials does the car still operate, and for which materials does the car not operate? Why do you think this is?
??? ?Extra: Are the wireless signals transmitted by other devices blocked by the same material(s) that you found could block the signals from the remote control in this activity? You can try this activity again but using other remote control devices, such as your TV or stereo remote. How do different wireless devices respond? Do you think they use similar or different types of waves?
??? ?Extra: Do you need to completely cover the radio-controlled car remote control to block its signal? Using the material(s) you found to block the signals from the remote control to the radio-controlled car, completely cover the remote control as you originally did in this activity, and then slowly remove the covering from the remote control while trying to operate the car. How much covering is needed to block the signal? Are some parts of the remote control more important to cover in order to block the signal?

College basketball: Wildcats take on resurgent Utes tonight

OGDEN ? A couple of weeks ago, when the University of Utah men's basketball team was stumbling and struggling through a dreadful eight-game losing streak, tonight's game against a solid Weber State squad looked like a lost cause.

But now, with the Utes having won back-to-back games and seemingly starting to figure things out, the Wildcats figure they'll have their hands full.

That's certainly the way WSU head coach Randy Rahe sizes up the situation facing his team tonight when the Utes invade the Dee Events Center ? very possibly for the last time, with Utah's move to the Pac-12 Conference making future trips to Ogden doubtful.

"I'll tell you one thing right now, they're a different team these last three games than they were before that," he said. "They're starting to understand how they're going to play; they're playing with a lot of aggression; they're playing tough, and they're playing physical.

"I watched the BYU game, and they absolutely physically beat the heck out of BYU. They're playing aggressive and guarding really, really well, and you can just start to see 'em come."

Rahe has reason to be concerned.

After playing instate rival BYU tough in what turned out to be a 19-point loss, the Utes claimed a 71-59 victory over Idaho State. Then on Monday night, while Weber State was busy pounding NAIA opponent Mayville State by 49 points, Utah slipped past the University of Portland by a 72-67 margin.

Senior point guard Josh "Jiggy" Watkins leads the Utes in scoring with 16.7 points per game, which ranks second-best in the Pac-12, and he poured in a season-high 26 points in Monday's win over the Pilots from Portland. Junior forward-center Jason Washburn adds 11.5 ppg had a team-best 7.0 rebounds per game, which is sixth-best in the Pac-12.

"They're starting to find their stride, which you knew they were going to do," Rahe said of the Utes. "They've got some really good players. I mean, Jiggy can play, he's as good a point guard as there is out there. The Washburn kid is a big ol' kid inside with mobility and touch and hands, and the Martin kid can shoot the absolute tar out of the ball.

"It just took them awhile to find their way, and now that they've found it, they're going to be playing very, very confident, so we know we've got our hands full. There ain't no doubt about that. We're going to have to prepare really hard ... and get in the right mindset to get ready to go fight 'em, because it's going to be a tough, tough game. We're very aware of that."

The Wildcats will counter with a lineup which, though missing two front-line starters due to injuries, is spearheaded by junior guard Damian Lillard, who scored 28 points in just 24 minutes in Monday's blowout win.

Developers seeing four times the revenue on iPhone compared to Android (Appolicious)

With the year coming to a close, lots of people are taking a look back at 2011 to see how various mobile markets have fared. For many developers working on both Apple?s iOS platform and Google?s Android, 2011 might look like the year iOS paid a whole lot more than Android (again).

According to new data from market research firm Distimo, developers made four times as much revenue making apps for the iTunes App Store compared to the Android Market, at least among the top 200 apps in both spaces. Meanwhile, iPad developers made twice as much as their Android-inclined counterparts, as TechCrunch reports.

That?s in spite of Google saying for most of the year that it was seeing some 500,000 device activations daily (a number it just revised up to 700,000). Despite having so many devices out there, Android still suffers from the same problems it always has: app discovery and fragmentation of the market. It?s harder for customers to find Android apps that work for their devices, so it?s harder for developers to make money creating them.

One place Android outpaced iOS, however, was money made with the ?freemium? game model. These are games that players download for free but which offer in-game purchases that push game progress forward. Distimo found that 65 percent of the revenue generated by the top 200 apps in the Android Market came from freemium titles. In the iTunes App Store, it was just under half.

The App Store is still the largest among all the major players, having grown from about 300,000 apps in January 2011 to around 430,000 by November for the iPhone, and rising from about 60,000 to about 150,000 for iPad. Google?s Android Market is keeping pace, but still has significantly fewer apps ? it grew from about 150,000 apps in January to just over 340,000 in November.

Apple also still leads in games, the most downloaded category of apps and the one that generates the most revenue. This might account for some of the discrepancy between iOS and Android. Apple offers 79,077 game apps in the App Store (with another 28,633 designed specifically for the iPad), while Android offers only 46,045.

And as we?ve heard before, China is now accounting for a huge number of app downloads for iOS. We discovered this year that China has become Apple?s second-largest market, and that holds true for the App Store as well. Distimo found that in January, China accounted for downloads equal to about 18 percent of U.S. app downloads, but by November, that number had grown to 30 percent. With iPad apps, China?s downloads are nearly the same as U.S. downloads.

All these numbers paint a picture that shows how powerful apps were in 2011 and are sure to be going into 2012. While Google is still pulling in lots of new users and selling new devices, it?s clear that the Apple model is continuing to work better for developers and users alike. How things will change for both companies in 2012 is yet to be seen, obviously, but with popular devices like the iPad 3 and the iPhone 5 on the horizon, it seems like iOS could be positioned to spend another year as the dominant platform, at least in terms of apps.

Merkel downplays possible S&P downgrade (AP)

BERLIN ? Chancellor Angela Merkel is downplaying the news that Standard & Poor's is examining the credit rating of 15 eurozone countries for a possible downgrade, saying the region is on the path out of its financial crisis.

She told reporters Tuesday that "what a rating agency does is the responsibility of the rating agency" but that leaders would plot a course to "regain confidence" when they meet later this week.

She says "I have always said this is a long process... and it will continue, but we charted the course yesterday with the French president and we will continue to stay the course."

Markets have been jittery following the news that S&P had placed 15 nations on notice for possible downgrades, including France and Germany, which both have a AAA rating.

Nearly a third of all NFL head-coaching jobs could become vacant after the 2011 season.? In addition to the Jaguars, teams that could (emphasis ?could?) make a change presently include, in no particular order other than the order in which I scan through the league?s eight divisions, the Dolphins, Colts, Chiefs, Chargers, Giants, Eagles, Vikings, Buccaneers, and Rams.

So who will replace these coaches?? Beyond Bill Cowher, Jon Gruden, and Jeff Fisher, there aren?t many (any) obvious candidates.

Let?s consider the three categories from which head coaches typically emerge:? former NFL head coaches, current NFL assistant coaches, and college head coaches.

Former NFL head coaches:? In the hopes of not omitting anyone (a sentiment that applies to all three categories), the list of former NFL coaches who could return ? and who currently are coaching ? includes Cowher (whose ?plan? to not coach in 2012 could change dramatically if the Giants job opens up), Jon Gruden, Fisher, Tony Dungy (who consistently has said he?s not coming back), Brian Billick, Jim Fassel, Dennis Green, Marty Schottenheimer, Eric Mangini, Jim Mora, Steve Mariucci, Brad Childress, Jack Del Rio, and Herm Edwards.

Of those, Cowher, Jon Gruden, and Fisher seem to constitute the ?A? list.? Billick wants back in, but he recently said he thinks Jacksonville will look to go younger and cheaper, which means he won?t be cheap.? (Or young.)? Edwards could be a surprise choice in Miami, if Carl Peterson takes over the football operations.? Mangini also has been linked to the Dolphins, although reports that he has been consulting with owner Stephen Ross are erroneous.

There?s another group of former NFL head coaches to consider ? those who aren?t yet former NFL head coaches.? Though it?s unusual for a newly-fired coach to get an NFL job right away, John Fox did it last year when jumping from Carolina to Denver.? The fact that Fox has instantly made the Broncos into a contender could make other former head coaches instantly attractive.? That list could (emphasis ?could?) include Tony Sparano, Jim Caldwell, Todd Haley, Norv Turner, Tom Coughlin, Andy Reid, Leslie Frazier, Raheem Morris, and Steve Spagnuolo.

Of those, Reid would be the most likely to land somewhere else right away, if he?s fired in Philly (or if he decides it?s time to walk away).? Also, a return by Coughlin to Jacksonville could be intriguing.? Spagnuolo also could get consideration elsewhere in 2012 as a head coach, although if Reid stays in Philly it makes sense for Reid to lure the team?s former linebackers coach back to town to run the defense.

Current NFL assistant coaches:? For starters, plenty of former NFL head coaches currently are working for other NFL teams.? The list includes Ravens offensive coordinator Cam Cameron, Browns defensive coordinator Dick Jauron, Rams offensive coordinator Josh McDaniels, Texans defensive coordinator Wade Phillips, Chiefs quarterbacks coach Jim Zorn, Lions offensive coordinator Scott Linehan, Vikings linebackers coach Mike Singletary, Dolphins defensive coordinator Mike Nolan, Bears offensive line coach Mike Tice, Chiefs defensive coordinator Romeo Crennel, Packers defensive coordinator Dom Capers, Bears offensive coordinator Mike Martz, Saints defensive coordinator Gregg Williams, Falcons offensive coordinator Mike Mularkey, and Redskins defensive coordinator Jim Haslett.

Of that group, Phillips and Haslett are the most intriguing.? Phillips has been a head coach three prior times, but his immediate transformation of a historically bad Texans defense merits consideration for a fourth opportunity, as linebacker Connor Barwin told NBC SportsTalk on Friday.? In Washington, the performance of Haslett?s stout defense has been overshadowed by a continuously struggling offense.

McDaniels already has been linked to the Chiefs, but that will be a difficult sell, given McDaniels? performance in Denver and, more recently, St. Louis.

The universe of assistant NFL coaches who have never worked as NFL head coaches yields a smaller range of relatively obvious choices.? Cowboys defensive coordinator Rob Ryan, the fraternal twin of Jets coach Rex Ryan, badly wants to make the next step.? Unlike Rex, who successfully kept a sock in it until he became a head coach, Rob arguably is talking a bit too much for a guy who isn?t a head coach.? (Rob also needs to visit the barber.)

Beyond Rob Ryan, there aren?t many/any hot names, which typically come from the staffs of the hottest teams.? In Green Bay, there?s a perception that Mike McCarthy is primarily responsible for the success of the franchise, which undermines the contributions of offensive coordinator Joe Philbin and quarterbacks coach Tom Clements.? On defense, assistant head coach/inside linebackers coach Winston Moss could get some consideration, as could outside linebackers coach Kevin Greene (who also would benefit from a trip to the salon).

The 9-2 49ers also should generate some candidates, starting (and perhaps ending) with defensive coordinator Vic Fangio.? With head coach Jim Harbaugh getting nearly all of the credit for the team?s performance, Fangio is really the only name that currently stands out.

Ravens defensive coordinator Chuck Pagano may not get much buzz given that it?s his first year on the job, but that assignment has become a launching pad for head coaches.? If the Ravens play deep into the postseason, Pagano could get consideration.

Another first-year coordinator seems to be the perfect fit for the one vacancy that already exists.? In a Wednesday visit to PFT Live, Mike Dempsey of 1010XL suggested Bengals offensive coordinator Jay Gruden as the next coach of the Jaguars.? It makes sense, on every level.? Gruden fits Brian Billick?s ?young and cheap? demographic, but Gruden also brings name recognition of his older and more expensive brother.? The name carries the most weight in northern Florida, where Jon won a Super Bowl and where Jay was a mainstay in the Arena League.? Then there?s the fact that Jay Gruden has gotten the most out of rookie quarterback Andy Dalton, who was drafted one round behind Blaine Gabbert.

(As a reader has pointed out in the comments, Bengals defensive coordinator Mike Zimmer could end up being considered for one of the various vacancies.? Ditto for Giants defensive coordinator Perry Fewell, who served as the interim coach in Buffalo and who has gotten some consideration for prior vacancies.)

College head coaches:? The instant success of Jim Harbaugh after stints with Stanford and the University of San Diego (not to be confused with, as I have in the past, San Diego State University) could reverse the perception that college coaches can?t get it done in the NFL.? It shouldn?t.? Harbaugh is the exception to the rule that the most important skills possessed by college head coaches ? recruiting ? are largely wasted at the NFL level.

Iowa?s Kirk Ferentz periodically is mentioned as a candidate to coach at the NFL level, and he?ll again be linked to Kansas City if Haley is fired.? Beyond Ferentz, the list currently is short to nonexistent.

UPDATE 10:00 a.m. ET:? I deliberately omitted former Packers coach Mike Sherman from the list of former NFL head coaches who could return, since he hasn?t coached in the NFL since 2005 and he has generated little or no buzz since being fired by the Packers.? But Jason La Canfora of NFL Network reports that the Jaguars contacted Sherman even before firing Jack Del Rio.? If true, it means that Brian Billick?s ?younger and cheaper? description of the Jags? job requirements perhaps should be reduced to simply ?cheaper.?

Boeing's Plan to Return to the Moon by 2022 (ContributorNetwork)

NASA Space Flight is reporting that Boeing made a presentation at the latest Global Exploration Workshop of a plan to return Americans to the moon by 2022, 50 years after the last astronauts walked on the moon.

The Boeing plan, which uses a "way station" located at the L1 point where the gravities of the Earth and moon cancel one another out as well as a reusable lunar lander is the first detailed approach to a return to the moon.

What would the way station look like?

The way station would be constructed at the International Space Station, using the remote manipulator arm. It would consist of a "Node4/DHS (Docking Hub System), an orbiter external air lock, a MPLM (Multi-Purpose Logistics Module) habitat module, and an international module." The various modules would be launched to the ISS with commercial rockets such as the Atlas V. Once assembled, a "space tug" would convey the way station to the L1 point.

How would the reusable lunar lander work?

A Space Launch System Heavy Lift launcher would deliver a fuel depot to the way station. Then a second SLS would deliver an Orion Multi Purpose Crew Vehicle and a reusable lunar lander. The lunar lander would take on fuel at the depot and then proceed on to the moon with the crew delivered by the Orion. The crew would conduct lunar surface operations, then return to the way station, transfer to the Orion, and return to Earth. Commercial launchers would top off the fuel depot as needed for subsequent lunar missions.

There is also a secondary plan that involves deploying the reusable lunar lander at the way station while it is built at the ISS. The SLS would launch an Orion MPCV and a Delta Cryogenic Second Stage (DCSS) to the way station. The DCSS would transfer fuel to the lander and then would boost it to the moon. As in the first scenario, the crew conducts lunar surface operations, then returns to the way station, transfers to the Orion, and returns to Earth.

The advantage of the second scenario over the first is that the long term storage of fuel is not necessary. The problem of preventing "boil off" of cryogenic fuel is one that would have to be solved before long term, space based depots become practicable.

What are the advantages of the Boeing plan?

Billions of dollars would be saved with a reusable lunar and one launch of an SLS per lunar mission. The way station could also be used as a base for running tele-operated robots on the lunar surface and deploying lunar surface infrastructure such as habitats.

What are some show stoppers?

The official plan, as articulated by President Obama, is still to bypass the moon and go to an Earth approaching asteroid. Also some analysts, such as Clark Lindsey, claim that there will be no money available for a way station and a reusable lunar lander and a heavy lift Space Launch System. But Lindsey's prediction of what the fiscal and political situation of 2018-2022 when this hardware would be developed and deployed remains idle conjecture, projecting the current situation into the future without changes that might be brought about by an election of a new administration.

Dump truck hits bus in Haiti, 5 die (AP)

PORT-AU-PRINCE, Haiti ? A Haitian mayor says a dump truck has slammed into a bus in a western coastal town, killing at least five people.

Mayor Santos Alexis of Leogane says the dump truck rear-ended the bus as it was letting off passengers at an intersection. The collision propelled the bus forward and it struck several motorcycle riders. Three of them died.

Two pedestrians also died, one because the bus struck a utility pole, snapping an electric cable that fell and electrocuted him.

At least 11 others were injured.

The accident happened just after 9 am Friday.

Mohamed Mohamud: Terrorism Case Comes Together Against Muslim-American 'Wannabomber'

PORTLAND, Ore. (RNS) A year ago, a tall, skinny teen named Mohamed Mohamud stepped out of an SUV just north of Portland's Union Station. There, according to the FBI, the Somali-born American punched 10 digits into a cell phone believing it would ignite a vanload of explosives 16 blocks away.

The van was parked on the southeast corner of Pioneer Courthouse Square on the night of Nov. 26, 2010. Out on the wet bricks, thousands of bundled-up revelers waited for the lighting of the city's 75-foot Christmas tree.

Twenty minutes before the lights sparkled to life, the teen known to friends as "Mo" pushed the phone's send button to detonate the explosives, the FBI alleges. Mohamud heard no blast, only the sudden footsteps of federal agents.

The 19-year-old became one of America's accused "wannabombers." The bomb he allegedly tried to ignite was a harmless fake rigged by the FBI and presented to him by undercover operatives posing as Islamic terrorists. Their suspect, charged with attempting to use a weapon of mass destruction, was part of a series of FBI terrorism stings since 9/11.

Government officials have praised the stings as a means of preventing terrorists from harming people on U.S. soil. In some cases, the FBI has supplied suspects with money, transportation and realistic weapons -- including surface-to-air missiles.

Defense lawyers, including Mohamud's, argue that the operations amount to illegal entrapment. Mohamud became the 14th and youngest suspect to mount an entrapment defense in one of the FBI's stings. The 13 men who previously argued entrapment have been tried, found guilty and sent to prison for terms ranging from six years to life.

Mohamud's trial is set for May 15.

Prosecutors and defense lawyers haven't talked publicly about the Mohamud case since a few days after his arrest. But their arguments over the release of thousands of pages of evidence -- some classified -- and surveillance files foreshadow a lively trial.

Mohamud's lawyers accuse the FBI of tailing their client, a vulnerable teen with no criminal record, perhaps before he turned 18. Then, they say, the bureau loosed sophisticated operatives on their client and coaxed him into a crime he never would have committed on his own.

Defense lawyers allege that the operatives, well-versed in psychological techniques to gain Mohamud's "compliance," cozied up to him with a plan. The operatives, they wrote, told Mohamud he'd been hand-picked, and they gave him $2,810 to buy bomb parts and rent a hideout. They also assured him they would sneak him out of the country after the bombing.

Prosecutors say the FBI grew suspicious of Mohamud after learning that a friend of his in the northwest frontier of Pakistan -- a known training ground for terrorists -- had emailed him an apparent invitation to join him. Their court filings also allege that Mohamud wrote articles advocating holy war, which were published in the online publication Jihad Recollections.

They argue that Mohamud was the first to bring up the idea of a bombing, picked Pioneer Courthouse Square as the target and gave a pre-bombing speech in which he criticized his parents for holding him back from jihad. Finally, prosecutors allege, Mohamud eagerly dialed a cell phone number hoping for bloodshed.

Mohamud was in his late teens when his dad, Intel engineer Osman Barre, took concerns about his son to the FBI. But that meeting -- and the year it occurred -- haven't been disclosed in a public case file now 558 pages thick.

Mohamud's defense team has suggested that the FBI might have begun eavesdropping on their client in March 2008, when he was 17.

The defense also pointed out that FBI agents were listening in when state police questioned him in 2009 about a Halloween date-rape accusation at Oregon State University. To prove his innocence (he was soon exonerated), Mohamud took a polygraph exam and let police copy data from his computer and cell phone.

FBI agents weren't involved in the campus case. But they obtained a copy of Mohamud's computer hard drive and three pages of information from his cell phone, court records show. One week later, according to the defense, an undercover FBI agent identified in court papers as "Bill Smith" emailed Mohamud and solicited his participation in violence against the West.

Government prosecutors say the FBI's sting took form in June 2010, when Mohamud tried to board a flight to Alaska for a summer job and learned he was on the no-fly list. The FBI soon interviewed Mohamud, who told agents he had previously planned to fly to Yemen to visit a friend, who later turned up in Pakistan.

A little more than a week later, an FBI operative posing as an associate of Mohamud's friend, sent him an email. The two men agreed to meet in Portland on July 30. There, prosecutors allege, Mohamud first brought up the subject of a car bombing.

Mohamud's defense strategy might be broader than entrapment.

Jail visitation records obtained by The Oregonian show that three potential defense experts have met with Mohamud. Each could offer unique insights about his Muslim identity and childhood in war-torn Somalia.

Dr. Dave Kinzie, an Oregon Health & Science University psychiatrist, began meeting with Mohamud last May. Kinzie, an expert in post-traumatic stress disorder, has studied refugees struggling with memories of war in such countries as Somalia, where Mohamud was born in 1991. He declined to discuss his visits with Mohamud.

Dirgham H. Sbait, a Portland State University professor who holds a Ph.D. in Arabic literature, began visiting Mohamud in July. Sbait acknowledged he's helping Mohamud's defense with Arabic language assistance, but he declined to elaborate.

A man identified as Jeff Eamon met with Mohamud in September. Eamon could not be reached for comment. But online citations credited to a man by that name show he published papers on the impact of anti-terrorist financing policies on Islamic charities and the reshaping of Muslim identity.

Mohamud moved last June from a corner cell on the fourth floor of the Justice Center Jail, where he spent nearly seven months being protected from other inmates. He now lives in a less restrictive unit, where he socializes with fellow prisoners, takes walks and watches TV.

"For his long-term health, I needed to get him out of there," said Mike Shults, chief deputy of corrections for the Multnomah County Sheriff's Office. "It's never good to isolate somebody for such a long period."

Mohamud's new cell sits about 400 yards from Pioneer Courthouse Square.

New methods for creating 3-D nanostructures deposited on an array of regularly spaced indentations on the surface of silicon films opens the door for innovative nanosensors

Scientists have shown that it is now possible to simultaneously create highly reproductive three-dimensional silicon oxide nanodots on micrometric scale silicon films in only a few seconds. Xavier Landreau and his colleagues at the University of Limoges, France, demonstrated in their paper to be published in EPJD that they were able to create a square array of such nanodots, using regularly spaced nanoindents on the deposition layer, that could ultimately find applications as biosensors for genomics or bio-diagnostics.

They used a process called atmospheric pressure plasma-enhanced chemical vapour deposition. This approach is a much faster alternative to methods such as nanoscale lithography, which only permits the deposition of one nanodot at a time. It also improves upon other silicon oxide growth processes that do not make it possible to precisely order the nanodots into an array. In addition, it can be carried out at atmospheric pressure, which decreases its costs compared to low-pressure deposition processes.

One of the authors' goals was to understand the self-organization mechanisms leading to a preferential deposition of the nanodots in the indents. By varying the indents' interspacing, they made it comparable to the average distance travelled by the silicon oxide particles of the deposited material. Thus, by adapting both the indents' spacing and the silicon substrate temperature, they observed optimum self-ordering inside the indents using atomic force microscopy.

The next step in their research will be to investigate how such nanoarrays could be used as nanosensors. They plan to develop similar square arrays on metallic substrates in order to better control the driving forces that produce the highly ordered self-organisation of nanodots. Further research will be needed to give sensing ability to individual nanodots by associating them with probe molecules designed to recognise target molecules to be detected.

GOP Presidential candidate Michele Bachmann will not be her party's nominee.

Sorry, hardcore believers out there. It's not personal, it's just not happening. But why let that stop her from speculating on who she'd pick as her Vice President in 2012?

"I have just the highest respect for Rick Santorum. He's a very sharp guy, and I could easily see making him attorney general," Bachmann tells the Des Moines Register.

"There's a lot of great people out there. And Donald Trump is someone that I think a lot of people would be intrigued with, too," added Bachmann, hilariously.

Trump, of course, toyed with the idea of running for U.S. President himself this year, then backed down, implying he could've won if he tried, but wasn't up for it.

He's the best.

Syria hit with new sanctions: Will this weaken Assad?

The Arab League hit Syria with sanctions Sunday. The new sanctions include a travel ban on Syrian officials and a freeze on Syria government assets.

The Arab League approved economic sanctions on Syria on Sunday to try to force Damascus to halt an eight-month crackdown on protests against President Bashar al-Assad that Qatar said may prompt international intervention.

Anti-Assad activists said there was no respite from the crackdown and security forces had killed at least 24 civilians, many in a town north of Damascus that has become a focus for protests demanding Assad's removal. Others were killed in raids on towns in the province of Homs.

Nineteen of the League's 22 members approved the decision to immediately enforce the sanctions, hailed by Britain as unprecedented. They include a travel ban on top Syrian officials and a freeze on assets related to Assad's government.

"The indications are not positive ... the sanctions are still economic but if there is no movement on the part of Syria then we have a responsibility as human beings to stop the killings," Sheikh Hamad bin Jassim al-Thani, Qatar's prime minister and foreign minister, told reporters.

"Power is not worth anything when a ruler kills his people," he said, adding that the sanctions were also aimed at halting dealings with Syria's central bank and investment in Syria.

Sheikh Hamad said Arab nations wanted to avoid a repeat of what happened in Libya, where a U.N. Security Council resolution led to NATO air strikes. He warned other Arab states that the West could intervene if it felt the league was not "serious."
"All the work that we are doing is to avoid this interference," he said.

British Foreign Secretary William Hague said the "unprecedented decision to impose sanctions demonstrates that the regime's repeated failure to deliver on its promises will not be ignored and that those who perpetrate these appalling abuses will be held to account."

Hague said Britain hoped the move would help break what he called United Nations silence "on the ongoing brutality taking place in Syria" after Russia and China thwarted Western efforts to pass a U.N. Security Council resolution on Syria.

Damascus, where the Assad family has ruled for 41 years, says regional powers helped incite the violence, which it blames on armed groups targeting civilians and its security forces.

The president of the Union of Arab Banks, a division of the Arab League, expected the sanctions to hit Syria's central bank, which he said has "big deposits" in the region, especially the Gulf.

"Once individual countries that have voted for the sanctions issue instructions, Syrian deposits will be frozen, which will affect the financial resources of the Syrian government," Adnan Youssef told Arabiya television.

Arab ministers were spurred to action by worsening violence in Syria and by the Assad government's failure to meet a deadline to let in Arab monitors and take other steps to end its crackdown on the uprising.

"It is a symbolic but a huge step. The Arab League has tried to stop civilian killings but it failed. Now it is removing the Arab cover from the regime, which could make it easier for the international community to intervene," said opposition figure Walid al-Bunni.
"No one wants to see ordinary Syrians deprived of essential supplies. The Arabs are telling Bashar: 'You are killing the people to whom you say you belong. We will not receive you in our capitals. We're freezing your assets. We are not investing in your country,'" Bunni said from Cairo.
