Senate panel delays CIA nominee Brennan's confirmation vote

WASHINGTON (Reuters) - The Senate intelligence committee on Wednesday postponed until next week a vote on the confirmation of White House aide John Brennan to be CIA director, dashing hopes of Democratic leaders who had hoped to have a vote on Thursday.

The committee's Republican vice chairman, Senator Saxby Chambliss of Georgia, said the panel expects to hold the vote on Tuesday.

No explanation for the delay was immediately available. However, the Obama administration has been at odds with members of the committee's Democratic majority over White House unwillingness to disclose some highly classified legal documents related to "targeted killings," including the use of lethal drone strikes against suspected militants.

While the administration allowed members of the intelligence committee to review copies of four such documents, it has refused to turn over what Senate officials believe are at least seven related memos.

On Wednesday, administration officials met with intelligence committee members to discuss the contents of the disputed documents. Copies of the material were not turned over to the committee, however, said a source familiar with the matter.

Senator Ron Wyden of Oregon, a key committee Democrat who had indicated earlier his preference that the vote not be held until the administration made additional disclosures, said late on Wednesday he was still not satisfied with what the White House had provided.

"Americans have a right to know when their government believes it is allowed to kill them, and that's what getting these documents" is about, Wyden said.

"I've made it very clear to the White House that we need those legal analyses before we vote," Wyden said. But he added: "There is certainly additional time to work this out."

Editorial Google Glass contest underlines mediocre uses for brilliant tech

Google's #ifihadglass contest advertises for "bold, creative individuals" to start carrying pre-production builds of Glass later this year. Since most people flatter themselves as dauntless and inspired, Google's challenge casts a wide net and applications are piling into Twitter. The contest apparently also seeks prosperous individuals willing to pay $1,500 for the prize, plus travel expense to pick it up. There might be good fiscal reasons for Google's parsimony, but I can't help noting that the $12 million of revenue generated by eager beta testers represents five-thousandths of 1 percent of the company's market cap, or one-tenth of a percent of its liquid cash.

Putting aside whatever demographic-shaping is in play, the more interesting question is whether Google will find its desired 8,000 bold creative types. The applications do not foretell blazing originality among foaming early adopters. If there is a depressing strain of mediocrity in the #ifihadglass Twitter stream, perhaps it speaks less to human limitation and more to intrinsic constraints of the device as it is currently understood.

JOHANNESBURG (AP) ? In South Africa, where Oscar Pistorius is charged with premeditated murder in the Feb. 14 shooting death of his girlfriend, Reeva Steenkamp, gun owners can only use lethal force in stringently regulated circumstances. Here is a brief look at gun laws in selected countries:

RUSSIA: For self-defense, Russians can only use hunting rifles and non-lethal weapons, such as devices that spray irritants or pistols that fire rubber bullets. Russian law is extremely vague on when such weapons can be used. The law doesn't, for example, spell out when people can shoot at intruders. Courts have handed prison sentences to people for "exceeding the limits of admissible self-defense," even when they used weapons in response to a clear threat to life.

COLOMBIA: Citizens have the right to defend themselves with a deadly weapon against "unjust aggression." The response must be proportional to the aggression, the criminal code says. This sanctions deadly force during home invasions. Attorney Jaime Granados said the issue of proportionality is crucial. One cannot, for example, shoot someone simply for petty theft.

FRANCE: Firearms can be used for "legitimate defense," said national police spokesman Laurent Ricard. This is only when people face "immediate attack." An armed response must be proportional to the attack. For example, a person cannot use a gun against an attacker who comes at them with a chair.

SOUTH AFRICA: Licensed gun owners are allowed to use lethal force only if they believe they are facing an immediate, serious and direct attack or threat of attack that could either be deadly or cause grievous injury, said Johannesburg attorney Martin Hood, who specializes in firearm law.

Someone On eBay Says They Have A Pair Of ... - Business Insider

Google Glass, the search giant's Internet-connected headset which lets you take photos and videos and access information, is hard to get.

If you want one, you either have to be a developer who's creating special apps for the devices, or you have to enter a contest Google is holding for creative types who describe what they plan to do with Glass and tag the post on Google or Twitter with "#ifihadglass."

Maybe there's a third way: Spend thousands of dollars on eBay.

A eBay seller claims to have a pair, and is?auctioning off a Google Glass headset on the site right now.

Bids are up to?$6,300. So far there have been 26 bids. The auction ends Thursday afternoon.

The auction seems fake.?Google has said it won't be contacting winners of its contest until mid-to-late March.

Plus, the only images the seller has are of their set of Google Glass are official publicity stills from Google.

Still, the seller claims he's been selected as an "early adapter" [sic] and estimates delivery on or before March 5.

We've asked Google and eBay what's up with this listing.

ASUS FonePad official 7inch tablet with phone functionality, priced at $249 for 16GB handson

We already knew ASUS was prepping a product called the FonePad, a 7-inch tablet with built-in phone functionality (yes, just like the new Samsung Galaxy Note 8.0). Well, ASUS just formally unveiled it here at Mobile World Congress, which means we've got a few more details to share than we did previously. First off, the speculation about its specs was all true: this does indeed have an Intel processor -- a 1.2GHz Atom Z2420, to be exact -- along with 1GB of RAM, a PowerVR SGX540 GPU, Android 4.1 Jelly Bean and an HSPA+ radio. Additionally, the 4,270mAH battery is said to get up to nine hours of runtime, which would put this in the same league as other Atom tablets we've tested recently.

In terms of hardware features, the FonePad has a smooth metal back (available in gray and gold), making it drastically different in appearance from the similarly sized Nexus 7. 'Round back you'll find a panel where all the usual antennae are, and hidden underneath is both the micro-SIM slot and the microSD reader. That microSD slot, by the way, supports 32GB cards, which should come in handy considering this has just 16GB of built-in storage. Additionally, the tablet has a 3-megapixel rear shooter and a 1.2-megapixel front camera, attached to a 7-inch, 1,280 x 800 IPS display. (We'll be taking hands-on photos anyway, in case you're really curious.)

The FonePad will be available in Europe for £179 / €219. Here at MWC, ASUS also confirmed a US dollar price of $249, though we had heard rumblings it wouldn't actually be on sale here. In any case, the on-sale date will be confirmed at some later time. We're hoping to test one ourselves soon enough, but until then, stay tuned for the usual round of hands-on shots.

Florida defensive tackle Sharrif Floyd said last week at the NFL Scouting Combine that he?s ?been getting ready to put on a show here.?

He did just that this morning, running a pair of sub-5.0 second 40s at nearly 300 pounds. The question now becomes, would it qualify as a show he wants to watch?

While Floyd?s ability to rush the passer and his athletic talent will make him a high pick, he raised more than a few eyebrows during his media interviews, when he admitted he wasn?t much of a football fan.

Asked the fairly standard question of which player he modeled his game after, Floyd replied: ?I haven?t really watched the league in a long time. I first started watching it in 2007, but I did get to know Ndamukong Suh in 2010 so we have a good relationship and I?ve watched him play a couple of times.?

That?s right, a possible Top 10 pick in the NFL Draft only started watching football six years ago. And it?s not as if he?s one of the foreign-born players from a land where football wasn?t readily available around the clock. He grew up in Philadelphia, a place where there seems to be some degree of interest in the NFL.

Asked to elaborate on the fact he didn?t watch football until recently, Floyd said ?The first game I ever watched was the Super Bowl when the Colts won it in 2007.?

?It wasn?t that there was no interest, I just didn?t know nothing about it, so there was no reason to watch it,? he continued. ?Even when I started playing there was no?interest in watching it because I liked to play it instead of sitting down and being still and watching a game while all my friends were jumping around and getting excited for no reason.

?It just wasn?t a preference of mine, but now it is so I watch it and play it now.?

Asked what he was watching instead, Floyd talked about the Disney Channel and Cartoon Network.

Don?t get me wrong, as the parent of young children, there?s a good bit of Looney Toons on hand in my home as well. And away from work, I respect people who are well-rounded, and can talk about something other than football.

But a team is about to invest millions of dollars in a man who may or may not like the game he?s about to turn into a career.

We know he?s motivated now, having trained specifically for the Combine to put on the kind of show that would boost his draft stock and make him financially secure.

But how motivated will he be come the dog days of training camp, or a Wednesday practice in November when his team might be out of the playoff hunt?

Will he be watching film of his next opponent, or catching up on That?s So Raven re-runs?

It?s possible to be great at football without being absorbed by it, but it?s probably not the kind of thing you want to admit at a job interview, either.

Laser mastery narrows down sources of superconductivity

Identifying the mysterious mechanism underlying high-temperature superconductivity (HTS) remains one of the most important and tantalizing puzzles in physics. This remarkable phenomenon allows electric current to pass with perfect efficiency through materials chilled to subzero temperatures, and it may play an essential role in revolutionizing the entire electricity chain, from generation to transmission and grid-scale storage. Pinning down one of the possible explanations for HTS?fleeting fluctuations called charge-density waves (CDWs)?could help solve the mystery and pave the way for rapid technological advances.

Now, researchers at the Massachusetts Institute of Technology and the U.S. Department of Energy's Brookhaven National Laboratory have combined two state-of-the-art experimental techniques to study those electron waves with unprecedented precision in two-dimensional, custom-grown materials. The surprising results, published online February 24, 2013, in the journal Nature Materials, reveal that CDWs cannot be the root cause of the unparalleled power conveyance in HTS materials. In fact, CDW formation is an independent and likely competing instability.

"It has been difficult to determine whether or not dynamic or fluctuating CDWs even exist in HTS materials, much less identify their role," said Brookhaven Lab physicist and study coauthor Ivan Bozovic. "Do they compete with the HTS state, or are they perhaps the very essence of the phenomenon? That question has now been answered by targeted experimentation."

Custom-grown Superconductors

Electricity travels imperfectly through traditional metallic conductors, losing energy as heat due to a kind of atomic-scale friction. Impurities in these materials also cause electrons to scatter and stumble, but superconductors can overcome this hurdle?assuming the synthesis process is precise.

For this experiment, Bozovic used a custom-built molecular beam epitaxy system at Brookhaven Lab to grow thin films of LaSrCuO, an HTS cuprate (copper-oxide) compound. The metallic cuprates, assembled one atomic layer at a time, are separated by insulating planes of lanthanum and strontium oxides, resulting in what's called a quasi-two-dimensional conductor. When cooled down to a low enough temperature?less than 100 degrees Kelvin?strange electron waves began to ripple through that 2D matrix. At even lower temperatures, these films became superconducting.

Electron Sea

"In quasi-two-dimensional metals, low temperatures frequently bring about interesting collective states called charge-density waves," Bozovic said. "They resemble waves rolling across the surface of a lake under a breeze, except that instead of water, here we actually have a sea of mobile electrons."

Once a CDW forms, the electron density loses uniformity as the ripples rise and fall. These waves can be described by familiar parameters: amplitude (height of the waves), wavelength (distance between waves), and phase (the wave's position on the material). Detecting CDWs typically requires high-intensity x-rays, such as those provided by synchrotron light sources like Brookhaven's NSLS and, soon, NSLS-II. And even then, the technique only works if the waves are essentially frozen upon formation. However, if CDWs actually fluctuate rapidly, they may escape detection by x-ray diffraction, which typically requires a long exposure time that blurs fast motion.

Measuring Rolling Waves

To catch CDWs in action, a research group at MIT led by physicist Nuh Gedik used an advanced ultrafast spectroscopy technique. Intense laser pulses called "pumps" cause excitations in the superconducting films, which are then probed by measuring the film reflectance with a second light pulse?this is called a pump-probe process. The second pulse is delayed by precise time intervals, and the series of measurements allow the lifetime of the excitation to be determined.

In a more sophisticated variant of the technique, largely pioneered by Gedik, the standard single pump beam is replaced by two beams hitting the surface from different sides simultaneously. This generates a standing wave of controlled wavelength in the film, but it disappears rapidly as the electrons relax back into their original state.

This technique was applied to the atomically perfect LaSrCuO films synthesized at Brookhaven Lab. In films with a critical temperature of 26 degrees Kelvin (the threshold beyond which the superconductivity breaks down), the researchers discovered two new short-lived excitations?both caused by fluctuating CDWs.

Gedik's technique even allowed the researchers to record the lifetime of CDW fluctuations?just 2 picoseconds (a millionth of a millionth of a second) under the coldest conditions and becoming briefer as the temperatures rose. These waves then vanished entirely at about 100 Kelvin, actually surviving at much higher temperatures than superconductivity.

Ruling out a Suspect

The researchers then hunted for those same signatures in cuprate films with slightly different chemical compositions and a greater density of mobile electrons. The results were both unexpected and significant for the future of HTS research.

"Interestingly, the superconducting sample with the highest critical temperature, about 39 Kelvin, showed no CDW signatures at all," Gedik said.

The consistent emergence of CDWs would have bolstered the conjecture that they play an essential role in high-temperature superconductivity. Instead, the new technique's successful detection of such electron waves in one sample but not in another (with even higher critical temperature) indicates that another mechanism must be driving the emergence of HTS.

"Results like this bring us closer to understanding the mystery of HTS, considered by many to be one of the greatest problems in physics today," Bozovic said. "The source of this extraordinary phenomenon is slowly but surely running out of places to hide."

In the seventeen months since Muammar Qaddafi was killed, Libya has made building an army a top national priority. But progress toward achieving this goal has been slow at best, with an official admitting that he does not even know how many soldiers are currently in the army.

Public statements by senior Libyan leaders suggest that there is little disagreement over the notion that the country desperately needs a functioning military to ensure a peaceful transition ??and a clean break from the Qaddafi legacy of a weak army dwarfed by powerful brigades loyal to the autocrat?s sons. However, political will alone hasn't been enough to effect serious reforms.?

The decrepit, near nonexistent, state of the army two years after Libyans rose up against Qaddafi is a symbol of the interim government?s failure to begin developing institutions to guide Libya?s path toward a democratic state.?The hurdles to building an army reflect the broader struggles facing Libya as it seeks to define its national identity in the wake of 42 years of a regime based solely on the whims of one man.?

Over the past year, Libyan authorities have largely entrusted the revolutionaries who overthrew Qaddafi with the task of maintaining security across the country, punting on the responsibility of building new army and police forces. Militia fighters in a rainbow of uniforms?? not soldiers or police officers???remain the predominant public face of security in Tripoli and in other cities and towns throughout the country.

Absent a strong central command to manage the conduct of the thousands of local militias participating in security provision, many of the militias that overthrew Qaddafi remain intact and continue to operate outside the confines of law.??

The ?revolutionary legitimacy? of the local brigade members and their leaders far outweighs that of Qaddafi-era army officials.

In some cases, the government has authorized the creation of semi-formal umbrella groups for the militias like the Libyan Shield Forces; in others, local militias simply govern themselves.?

'In name only'

When Prime Minister Ali Zeidan took office last October, he declared that building professional army and police forces was his highest priority. But in the case of the army in particular, this goal remains out of reach.

Some Libyans describe it as existing ?in name only.? Many soldiers who served during Muammar Qaddafi?s rule and remained on the autocrat?s side during the 2011 uprising either were killed, fled the country, or have attempted to conceal their past loyalties in order to avoid persecution.

This raises the question of who exactly remains in the army. When asked to estimate how many soldiers there are, Giuma Sayeh, the head of the defense committee for the temporary General National Congress elected in July told The Christian Science Monitor he had ?no idea.?

Meanwhile, militia fighters remain as well-armed as soldiers. Research by the Geneva-based Small Arms Survey found that in Misurata, Libya?s third-largest city and the scene of some of the fiercest battles of the 2011 uprising turned civil war, revolutionary brigades control more than 90 percent of the city?s weapons.

"The primary security challenge facing Libya is how to transform a decentralized revolutionary force ? which is made up of hundreds if not thousands of separate units ? into state security structures that have democratic checks and balances,? says Brian McQuinn, an Oxford University doctoral student who has been studying Libyan armed groups since Qaddafi?s fall and is the author of a recent Small Arms Survey report on the same topic.?

Mr. McQuinn says that Libyan leaders are grappling with the need to build a new national army while also recognizing the importance of?accommodating?the many local groups of revolutionary fighters "who?sacrificed a great deal."

As for the efficacy of the current security arrangements ? overlapping and parallel forces operating independently of each other ? McQuinn expressed a widely held view: "What is the alternative at this point?"

Impossible task

Army chief of staff Yussef al-Mangush, a former colonel in Qaddafi?s army who retired from the army just before the revolution began, was appointed by the interim cabinet early last year and is now facing mounting opposition from GNC members.

?We are trying to nominate another chief of staff,? Mr. Sayeh

"He has tried to do something, but he is not capable because he is weak," he added, criticizing his management skills but stopping short of any comments about the colonel?s past role in Qaddafi?s regime.

Army chief of staff Yussef al-Mangush is in the unfortunate position of being increasingly unpopular among parliamentarians for his failure to make quick progress, while at the same time being tasked by the government with an ever-growing raft of responsibilities.

"People are calling for his dismissal but he keeps getting handed more responsibilities," says a Western official in Libya who spoke on condition of anonymity.? "Land, air, naval forces, border security. In theory he is powerful, but he is working with the shells of institutions."

Analysts say that aside from facing the tall task of rebuilding these institutions, al-Mangush is also grappling with the demands of powerful local militia commanders, few of whom are interested in ceding power to his authority.

Who can serve?

With Libya focused on?building new institutions, both in the security sector and elsewhere, and with the constitution-drafting process yet to begin, the question of who will be permitted to lead this process is being decided by the congress. In Tripoli this week, the 200-member General National?Congress is debating a draft of the Political Isolation Law, which will specify which Libyan citizens are ineligible to run for political office based on their past service of the Qadaffi government over 42 years.

Activists say the law is too expansive and will prevent many Libyans who had no choice but to serve in the government from playing a role in the building of the new state.

?We have educated people from the [former] navy, army, and air force,? says Sayeh. ?To be honest, some were with Qaddafi and they escaped, they are now outside the country. But some [from the former army] were clearly against Qaddafi under the table,? he says, expressing concern that experienced officers who could help lead the new armed forces would be prevented from doing so if the bill passes.

Revolutionaries who are still manning checkpoints and performing security duties on behalf of the state ?should go back to their jobs or be trained in military academies," he says.

A government program offering such choices to the tens of thousands of young Libyans who played roles in the revolution could be an appealing alternative to holding on to their weapons and their positions of local power.

Until such a program is created, however, the structure of security forces in Libya may continue to model that of the highly decentralized revolution.?

The current reality is a glaring reminder that although Libyans rose up in unison to bring down Qaddafi, there is less unity of purpose when it comes to the hard work of managing the country while it remains awash in arms and rife with militias that are not eager to return to civilian life.

Dell earnings fall 31 percent in 4Q

ROUND ROCK, Texas (AP) ? Dell Inc. on Tuesday posted another quarter of declining sales and profits, deepening a downturn that disenchanted shareholders and culminated in the slumping personal computer maker's recent decision to take its stock off Wall Street in a $24.4 billion deal.

The proposed sale, announced just two weeks ago, diminished the importance of the numbers released Tuesday.

The fourth-quarter report became even less significant when the company canceled CEO Michael Dell's previously scheduled participation on a conference call to discuss the results with analysts. Michael Dell, who founded the company 29 years ago, is leading the buyout, which is facing opposition from two of Dell Inc.'s biggest shareholders.

The company, which is based in Round Rock, Texas, declined to field questions about the deal or the shareholder efforts to wrangle a bid above the currently agreed upon price of $13.65 per share.

Southeastern Asset Management and T. Rowe Price, the company's two largest shareholders after Michal Dell, have said they will vote against the deal unless the offer is sweetened. The company's board so far has argued that the deal negotiated with Michael Dell and a group of investors led by Silver Lake is a fair one.

If the deal closes, it will end Dell's 25-year history as a publicly traded company. Michael Dell and his backers are betting that the company will be better able to diversify beyond the PC business without having to cater to the stock market's demands for higher profits from one quarter to the next.

Dell's slump stems from weakening demand for PCs as more technology spending shifts toward smartphones and tablet computers.

The most recent quarter showed Dell is still losing ground, although the drop-off wasn't quite as bad as analysts anticipated.

Dell earned $530 million, or 30 cents per share, for its fiscal fourth quarter, which ended Feb. 1. That was a 31 percent decline from $764 million, or 43 cents per share, in the quarter a year ago.

Excluding acquisition- and severance-related charges, earnings were 40 cents per share. That was a penny above the average forecast of analysts polled by FactSet.

Revenue totaled $14.3 billion, down 11 percent from a year ago. It beat analyst expectations at $14.1 billion.

Dell's stock gained 4 cents to $13.85 in extended trading after the financial results were released. That's an indication that some investors expect a slightly higher bid for Dell, given the stock is trading 20 cents above the current offer.

ID theft on rise: 12.6 million victims in 2012, study shows

Identity theft is on the rise again, says a new industry-sponsored study, reversing a promising two-year trend.?

Some 12.6 million Americans were victimized by ID theft in 2012, the second-highest total since the Federal Trade Commission began counting victims in 2003? and roughly 1 million more than 2011, according to the survey by Javelin Strategy and Research. The record ? 13.9 million victims ? was set in 2009. ?

The criminals made off with $3 billion more than in 2011, as well. ?Overall, slightly more than 1 in 20 consumers -- 5.26 percent -- were victims last year, the survey found.

A large portion of the increase was driven by "dramatic jumps" in more-serious forms of ID theft, such as new account fraud, where a criminal uses a victim's personal information to open new credit cards or other kinds of loans. New account fraud jumped 50 percent last year, according to the report, with the total fraud loss doubling year over year to just under $10 billion


"I don't think (the data) shows that banks are losing control," said Jim Van Dyke, author of the study, when asked about the significance of the new data. "But it's really wise to look at where we haven't gotten anything under control, and that's new account fraud."

The news comes amid a cascade of hacker stories this week, giving the impression computer criminals are gaining the upper hand on many fronts.? Agents working on behalf of the Chinese army have successfully attacked dozens of U.S. companies, according to a report issued Tuesday by U.S. security firm Mandiant.? Large U.S. media companies have also fought off Chinese hackers, and not always successfully, according to several reports. Burger King and Jeep suffered embarrassing Twitter account takeovers. And both Twitter and Facebook have had to announce in recent weeks that they had been hacked.

Javelin's data is based on telephone surveys of U.S. adults, with consumers self-reporting details of their ID theft to survey takers and results extrapolated from their answers. The precision of such data can be questioned, but Javelin has used the same techniques for eight years, making year-to-year observations informative. The same technique was used by the FTC in 2003 when it initially reported the size of the identity theft problem as required by Congress.

The survey was sponsored by CitiGroup, Visa, and Intersections LLC, which provides identity theft prevention services to consumers.? Van Dyke says the sponsors were not involved in tabulation, analysis or reporting of the results.

Bank security analyst Avivah Litan of the security consultant firm Gartner, who has run her own ID theft victim surveys in the past, said the Javelin survey's results are consistent with what she's heard from bank security officials.

"Even in an age of cyberespionage and advanced targeted attacks, good old-fashioned consumer identity theft continues to escalate," Litan said. "It's highly unfortunate that even after all this time and effort by banks regulators high tech entrepreneurs and law enforcement that the bad guys are still coming out ahead. It's high time that we put more intelligent efforts into winning this cyberwar, whether it?s against amateur identity thieves or foreign infiltrators."

Other interesting findings from the Javelin report:

*Consumers who received "breach" notifications from companies indicating their personal data had been compromised?were much more likely than others to be victims of ID theft. ?And that trend is rising. In 2011, 1 in 5 recipients were victims; and last year, the likelihood increased to 1 in 4.?

*Fraud victims living below the poverty line were more than twice as likely to know their imposter personally -- so-called "familiar fraud" -- than wealthier consumers. The survey found that 29 percent of poor victims knew their imposter vs. 12 percent of those living above the poverty line.

*It's important to note that despite the rise in new account fraud, simple credit card fraud still accounts for about two-thirds of all ID theft. Those victims had a relatively easy time fixing the problem, reporting an average of 11 hours of disruption. On the other hand, 51 percent of victims of "account-takeover fraud," which allows criminals to withdraw funds from existing checking accounts and run similar schemes, said their lives were "severely impacted" and they spent an average of 37 hours resolving their frauds.

Van Dyke also pointed out there are hidden victims in ID theft, in addition to banks and consumers who lose money.? Among consumers who were victims of fraud, 15 percent said they reacted by avoiding online retailers, and half of that group specifically avoided small retailers. Only 8 percent of that group said they avoided large merchants after a fraud.

"Small online merchants are really being singled out," he said.? In other words, they are hit both by fraud, and by lost sales due to the impression of risk created by fraud. "Consumers are very sympathetic to small merchants, but when you see this lack of trust play out, it underscores how significant the problem is and how important it is that we deal with it.?
